The legal effect of land registry entries based on notarial deeds and the remedy of erroneous entries in the new land registry system
Abstract
Act C of 2021 on the Land Registry has brought significant changes to the everyday lives of notaries, as the electronic and automated land registration procedure places a great deal of responsibility on them during the registration of rights and facts. According to the new Act, the control of the land registry authority has been reduced in respect of a significant part of the cases received, taking into account the fact that in the automated decision-making procedure it may only carry out substantive control with regard to the electronic form of the application or the official notice in the land registry, the transaction power of attorney, the authorisation of the legal representative to represent the data subjects during the procedure, the registration authorisation and the declaration of consent, but not with regard to the underlying document. The aim of this study is to present the legal effects of registration in the land registry and the way to remedy any erroneous entries that may have been made during the automated decision-making.
