The Conditions of Appointment of Judges and Notaries in a Nutshell

Abstract

In the present study, I have briefly described the respective characteristics of the judicial and notarial professions, the conditions of appointments of judges and notaries, the person exercising the power of appointment, the duration of the appointment, the age requirements, the citizenship criterion, the nature of the career aptitude test, the training requirements (including the required period of legal practice and the language proficiency requirement), and the obligation to make a declaration of assets. At the same time, I have also illustrated the similarities and differences in the regulation of the appointment of judges and notaries. Although there are many overlaps between the appointment conditions of the two professions, there are also significant differences. The latter is also interesting because the notary acts as a judge in a judicial capacity, and the grounds for disqualification also refer back to the judicial regulation. Regardless of the differences, however, the strict system of entrance criteria ensures that only the most suitable candidates can become judges and notaries.
