Recent developments in the changes of the structure of civil proceedings

Abstract

The study reflects on the legislative changes and the emerging practice of the higher courts in the field of the structure of proceedings since the entry into force of the Civil Procedure Code. Following a doctrinal introduction, the analysis of court decisions in the area of the commencement and the conduct of proceedings, as well as significant legislative changes in this area are examined. Particular attention is given to the written part of the statement of claim, the written counter-claim of the defence, the court order and the written part of the statement of case. The procedural acts to be carried out in the above-mentioned procedural elements are the ones which are the main focus of practice and legislation. Through all of this, the study aims to uncover judicial practice which can be related to the structure of legal proceedings.
