Product liability in Hungarian legal practice
Abstract
Technological developments in recent years have had a significant impact on our society, affecting social relations and economic functioning. These processes have brought about fundamental changes which pose new challenges to the traditional approach to jurisprudence. On the one hand, dogmatic legal thinking requires new approaches and, on the other, there has been an increase in codification, which is reflected in the adoption of new and significant amendments to existing legislation. The changes also affect the area of product liability, particularly due to changes in manufacturing processes and the proliferation of linked products, which cause uncertainties in the application of law in several areas, especially with regard to software and its updates. These uncertainties have prompted the adoption of the new Product Liability Directive. Taking into account the normative changes having taken place, this study examines Hungarian judicial practice with the aim of promoting a more effective application of the new regulations.
