Uniform EU regulation on the horizon in the field of international private law issues relating to the protection of adults

Abstract

In May 2023, the European Commission published the draft regulation of the European Parliament and of the Council on jurisdiction, applicable law, recognition and enforcement of measures and cooperation in matters relating to the protection of adults (hereinafter: Draft). In this short study, I aim to present its place in the EU legal order and its main regulatory aspects, with a special focus on the newly proposed institution of the European Certificate of Representation.
