Lehet agressziót kiprovokálni?
Oroszország Ukrajnával szembeni „kiprovokálatlan/kiprovokált” agressziójának nemzetközi jogi elemzése
Absztrakt
Amikor s amióta az Orosz Föderáció vezetői inváziót indítottak Ukrajna ellen, semmibe véve a modern nemzetközi jog egyik alapkövét, az államok közötti erőszak tilalmának kógens szabályát, sokak és gyakorta társítják a provokálatlan/provokált jelzőket Oroszországnak e kirívó jogsértéséhez. A tanulmány azt a terminológiai kérdést vizsgálja, miért helytelen az orosz agresszió (és általában bármely agresszió) kapcsán kiprovokálatlanságról beszélni, no pláne kiprovokáltságot emlegetni. A helyes szakszókincs használatára való felhívás szándék szerint mindazonáltal nem öncélú szaknyelvi elmélkedés, de Szerző reményei szerint tartalmi hozzájárulás is a jelenünk nemzetközi jogi rendszerét alapjaiban megrázó normasértést elemző szakirodalomhoz.A
