Békeszerződések az erőszak árnyékában
A kényszer hatására kötött megállapodások érvényessége a modern nemzetközi jogban
Absztrakt
A tanulmány azt vizsgálja, hogy a fegyveres konfliktusokat lezáró fegyverszüneti megállapodások és békeszerződések mennyiben tekinthetők érvényesnek, ha azokat szükségképpen az erőszak és a kényszer kontextusában kötik meg. Kiindulópontja, hogy az ENSZ Biztonsági Tanácsa a legtöbb államközi fegyveres összeütközésnél nem állapít meg agressziót, nem engedélyezi a fegyveres erő alkalmazását, és nem vesz részt a békekötésben – mégsem hivatkoztak a gyakorlatban a felek békeszerződések érvénytelenségére az erőszak/kényszer okán. A tanulmány bemutatja a szerződések jogáról szóló Bécsi Egyezmény releváns szabályait (különösen az erőszakkal/kényszerrel kötött szerződésekre, illetve a ius cogensre vonatkozó rendelkezéseket), majd konkrét esettanulmányok – többek között a közel-keleti, afrikai és latin‑amerikai békerendezések – alapján elemzi, hogyan ʻsemlegesíti’ a gyakorlat a kényszert. Rámutat a közvetítők, tanúk és garantáló államok legitimációs szerepére, az időbeli távolság jelentőségére (tűzszünet kontra későbbi békeszerződés), valamint arra a dogmatikai érvre, hogy a békeszerződés megkötése – a béke és biztonság helyreállítása – a nemzetközi jog rendjében elsődleges érték, amely a kényszer miatti érvénytelenségi logikát a gyakorlatban háttérbe szorítja.
